ข้อตกลงและเงื่อนไขในการว่าจ้าง

เวลาประเทศไทย (GMT+7) โดยปกตินักวาด active ช่วง 09:00 น. - 23:00 น.

⟡ ได้โปรดอ่านข้อตกลงก่อนว่าจ้าง หากลูกค้าได้เริ่มทำการว่าจ้างแล้ว เท่ากับลูกค้ายอมรับข้อตกลงทั้งหมดแล้วนะคะ
⟡ ลิขสิทธิ์ของงานยังเป็นของนักวาดเสมอ
⟡ ข้อตกลงไหนไม่มี ≠ ทำได้ ต้องมีการสอบถามพูดคุยกับนักวาด เพื่อตกลงกับนักวาดก่อนเสมอ
⟡ ห้ามเทรซ ห้ามทำซ้ำ
⟡ ห้ามนำงานไปใช้กับ ai เด็ดขาด╰┈➤ สิทธิ์ในการใช้งาน
⟡ Personal use ไม่อนุญาตให้นำผลงานไปใช้เพื่อสร้างรายได้ ผลกำไร หรือเพื่อการโฆษณา อย่างไรก็ตาม สามารถนำผลงานไปใช้ส่วนตัวได้ เช่น ใช้เป็นรูปโปรไฟล์ รูปปก โพสต์บนโซเชียลมีเดีย หรือรูปประกอบตารางงาน
⟡ Commercial content type อนุญาตให้นำผลงานไปใช้ประกอบการสร้างคอนเทนต์ การสตรีม หรือสื่อออนไลน์ที่สามารถสร้างรายได้ได้ เช่น Thumbnail, ภาพประกอบวิดีโอ, PNGTuber, ภาพโปรโมต หรือสื่อประกอบอื่นๆ
⟡ Commercial merchandising type สามารถนำไปสร้างรายได้ กำไร สินค้า เชิงธุรกิจได้ ซึ่ง ≠ สิทธิ์ขาด ลิขสิทธิ์ยังคงเป็นของนักวาดเสมอ╰┈➤ การชำระเงิน
⟡ งานของลูกค้าจะได้รับการลงคิว + เริ่ม เมื่อลูกค้าจ่ายทั้งหมดแล้วเสมอ ไม่มีการเริ่มงานก่อนชำระ
⟡ หากมีการจองคิวแล้ว มีเวลา 48 ชม. ในการชำระ หากเกินเวลาที่กำหนดการจองคิวจะเป็นโมฆะ แต่ยังสามารถจองใหม่ได้เสมอ ในที่นี้เค้าจะติดต่อไปเสมอว่ายังรับอยู่มั้ย หากไม่มีการตอบกลับจะนับเป็นการจองเล่นนะคะ หากมีการจองเล่นเกิน 2 ครั้งจะขอ Blacklist ทันทีค่ะ
⟡ ลำดับคิวจะเรียงตามการชำระเงินเสมอ╰┈➤ การคืนเงิน
⟡ หากต้องการยกเลิกการว่าจ้างต้องแจ้งนักวาดก่อนที่จะถึงคิว / งานเริ่ม จึงจะสามารถรับเงินคืนได้เต็มจำนวน
⟡ หากถึงคิว / งานได้เริ่มไปแล้วไม่มีการคืนเงินใด ๆ ทั้งสิ้น╰┈➤ การติดต่อ สื่อสาร
⟡ โดยปกตินักวาดจะเช็คแชทเป็นช่วงๆ หากแชทเกิน 4 ชม. ในช่วงเวลา active ที่ระบุไว้ตามด้านบนสามารถทักซ้ำได้เลยนะคะ
⟡ สามารถสอบถามงานได้เสมอด้วยความสุภาพ╰┈➤ การแก้ไขงาน
⟡ งานที่มีบรีฟ สามารถแก้ได้เสมอหากนักวาดทำไม่ตรงกับที่บรีฟไว้
⟡ งานตามใจนักวาด/omakese/skeb/surprise me ลูกค้าไม่สามารถแก้ไของค์ประกอบ หรือคอนเซปต์ของงานได้ สามารถขอแก้ไขได้แค่จุดเล็ก ๆ เท่านั้น
⟡ งาน custom จะสามารถแก้องค์ประกอบ หรือคอนเซปตได้ 2 ครั้ง ในขั้นตอนเช็คสเก็ตช์เท่านั้น
แต่สามารถแก้ได้ไม่จำกัดหากเป็นจุดเด่น/เอกลักษณ์ ของตัวละครที่นักวาดพลาดไป╰┈➤ การส่งงาน
⟡ ระยะเวลางานจะถูกระบุในแต่ละประเภทงาน
⟡ ไม่มีการลัดคิว แต่จะสามารถเร่งระยะเวลางานได้ ซึ่งจะถูกระบุไว้ในแต่ละประเภทงาน
⟡ จะมีการส่ง final ให้เช็คก่อนส่งไฟล์ต้นฉบับเสมอ

⟡ Please read the TOS before commissioning me. By commissioning me, you agree to all of the terms listed below.
⟡ The artist retains all copyrights to the artwork.
⟡ If a type of use is not explicitly stated as allowed, it does not mean it is permitted. Please ask and discuss it with the artist beforehand.
⟡ Do not trace or redo.
⟡ Do not use the artwork for AI╰┈➤ USAGE RIGHTS
⟡ Personal use The artwork may not be used to generate income, profit, or for advertising purposes. However, you may use it for personal purposes, such as profile pictures, banners, social media posts, schedules, and other personal uses.
⟡ Commercial content type The artwork may be used for content creation, streaming, or online media that generates income, such as thumbnails, video illustrations, PNGTubers, promotional images, and other related content.
⟡ Commercial merchandising type The artwork may be used for commercial or business purposes, including generating income, profit, or creating merchandise. This does not mean full ownership or exclusive rights — the artist retains the copyright at all times.╰┈➤ PAYMENT
⟡ Your commission will only be added to the queue and started after full payment has been received. No work will begin before payment.
⟡ After request has sent, payment must be made within 48 hours. after that your request will be canceled, but you are always welcome to reserve a new slot. I will contact you to confirm whether you are still interested. If there is no response, it will be considered a fake reservation. After more than 2 fake reservations, you will be blacklist
⟡ The commission queue is always ordered by payment.╰┈➤ REFUNDS
⟡ To receive a full refund, cancellations must be requested before your turn arrives or before work has started.
⟡ Once your turn has arrived or work has begun, refunds will not be available.╰┈➤ COMMUNICATION
⟡ The artist usually checks messages periodically. If you have not received a reply for more than 4 hours during the active hours listed above, feel free to send a follow-up message.
⟡ You are always welcome to ask about your commission, as long as communication remains respectful.╰┈➤ REVISIONS
⟡ For commissions with a provided brief, revisions are always allowed if the artwork does not match the requested details.
⟡ Omakase/Skeb/Surprise Me The client can't request changes to the composition or concept. Only minor adjustments may be requested.
⟡ Custom up to 2 revisions to the composition or concept are allowed during the sketch phase only.
However, corrections to important or distinctive character features that the artist accidentally missed can be requested without a revision limit.╰┈➤ DELIVERY
⟡ The estimated turnaround time will be stated for each commission type.
⟡ Queue skipping is not available. However, rush options may be available and will be specified for each commission type.
⟡ A final preview will always be sent for via dm before the final file is delivered.
